Arbitration:

Should no resolution be reached between Beastie and Bone and the users of www.beastieandbone.com in the event of a dispute related to, about, arising from or about these Terms, either directly or indirectly, then the dispute shall be resolved only by arbitration in accordance with the Federal Arbitration Act. A single neutral arbitrator shall conduct said arbitration, from either the American Arbitration Association or an arbitration service mutually agreed upon by both parties, and at a location mutually selected by both parties. Said arbitration shall be final, and survive the termination of these Terms. Judgement on said arbitration may be entered upon it in any court having jurisdiction. The prevailing party as determined by said arbitration shall be entitled to recover costs and attorney’s fees within reason. 

Class Action Waiver:

Any arbitration related to these Terms shall take place on an individual basis only, with no class arbitrations or class/representative/collective actions permitted. Additionally, the arbitrator may not preside over any proceeding that is representative or class action, or the consolidation of more than one person’s claims. 

Liability Disclaimer: 

Updates to www.beastieandbone.com occur intermittently to address typographical or informational inaccuracies in general information, products, services, and software contained in or available through www.beastieandbone.com, and such alterations may be carried out by Beastie and Bone at any time. Beastie and Bone also reserves the right to alter or terminate information, products, services, and software contained or available through www.beastieandbone.com at any time, with no notice and no liability of any kind.

Beastie and Bone’s adherence to these Terms is subject to all existing laws and legal process, and no part of in these Terms shall exempt Beastie and Bone from compliance with governmental, court, and/or law enforcement requests or requirements as relates to your use of, and any information you provide or gather from, Beastie and Bone or www.beastieandbone.com. If these Terms in any part are found to be invalid or unenforceable by applicable law, including but not limited to, the warranty disclaimers and limits of liability set forth above, then the invalid or unenforceable part shall be superseded by the part that closest matches the intent of the original provision. In such a case, the remainder of the Terms shall continue in effect. 

With exception of where otherwise specified, these Terms constitute the agreement in whole between the user and Beastie and Bone with the respects to www.beastieandbone.com, and supersedes all previous and/or contemporary agreements, proposals, or communications, whether oral, written, or electronic, between the user and Beastie and bone with respects to www.beastieandbone.com.
